2. Eligibility

You may use the Service only if you:

• Are at least 16 years old (or the minimum legal age in your jurisdiction to form a binding contract, if higher).
• Have the legal authority to enter into these Terms on your own behalf or on behalf of an organisation.
• Are not barred from using the Service under applicable law.

If you use the Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" will refer to that entity.

3. Account Registration and Security

To access certain features of Fanbea, you may need to create an account. You agree to:

• Provide accurate, current, and complete account information.
• Maintain and promptly update your information as needed.
• Keep your login credentials confidential and not share them with others.
• Notify us immediately if you become aware of any unauthorised use of your account or any other security incident.

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account if we reasonably believe that you have violated these Terms or that your use of the Service may harm us, the Service, or others.

4. Description of the Service

Fanbea is a platform that allows you to create and manage link pages and related content (such as text, images, and icons), connect domains, and share those pages publicly or privately.

We may update, improve, or modify features and functionality of the Service from time to time, including the user interface, available integrations, and limits. We may also remove or discontinue certain features, provided that we comply with applicable law and give notice where required.

5. Plans, Billing, and Payment

Some parts of the Service are offered free of charge, while other features require payment of fees (collectively, "Paid Plans"). Details of our Paid Plans, including pricing and available features, are described within the Service or on our website.

Unless stated otherwise:

• Fees are charged in EUR or another currency we specify.
• Subscriptions are billed in advance and automatically renew at the end of each billing period, unless you cancel before the renewal date.
• Payments are processed by third-party providers such as Stripe or others we may use from time to time.

You authorise us and our payment providers to charge all applicable fees to the payment method associated with your account. You are responsible for keeping your billing information accurate and up to date.

Except where required by law, fees paid are non-refundable, including for partial periods, downgrades, or unused Services. If we change the prices of our Paid Plans, the new prices will apply only to future billing periods. We will provide you with reasonable prior notice of any price changes, where required.

6. Acceptable Use

You agree not to misuse the Service or assist anyone else in doing so. In particular, you must not:

• Use Fanbea for unlawful, harmful, fraudulent, deceptive, or misleading activities.
• Publish or share content that is defamatory, hateful, harassing, discriminatory, or otherwise objectionable.
• Infringe or violate the intellectual property, privacy, or other rights of any person or entity.
• Send spam, bulk unsolicited messages, or run phishing or other abusive campaigns through or in connection with the Service.
• Upload or distribute malware, viruses, or other malicious code.
• Interfere with or disrupt the integrity, security, or performance of the Service or any related systems.
• Attempt to access the Service or related systems without authorisation, including by circumventing technical or access controls.
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except where such restrictions are prohibited by law.
• Resell, lease, or provide the Service as a standalone offering to third parties without our prior written consent.

We may investigate and take appropriate action (including removing content, restricting access, or terminating accounts) if we reasonably believe that you have violated these Terms or applicable law.

7. User Content

You retain ownership of any content, data, or materials you upload, post, or otherwise make available through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence (with the right to sublicense) to host, store, reproduce, adapt, display, and otherwise use your User Content as necessary to operate, maintain, and improve the Service, including to display your pages to visitors.

You represent and warrant that:

• You have all rights necessary to grant us the licence described above.
• Your User Content does not infringe or violate the rights of any third party.
• Your User Content complies with these Terms and all applicable laws and regulations.

We do not generally review or pre-approve User Content, but we may remove or disable access to any content that we reasonably believe violates these Terms, our policies, or the law, or that we consider harmful to the Service or others.

8. Intellectual Property in the Service

The Service, including its design, features, software, and all content (excluding User Content), is owned by or licensed to Yeabunny Sp. z o.o. and is protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own business or personal purposes. You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse engineer or attempt to extract the source code, except where such restrictions are prohibited by law.

9. Third-Party Links and Services

The Service allows you and other users to add links to third-party websites, services, and content, including social networks, shops, and affiliate destinations. We do not control and are not responsible for these third parties, their content, or their privacy or security practices.

Your interactions with third-party services are solely between you and the third party. You are responsible for reviewing the terms and privacy policies of any third-party services that you use or link to through the Service.

10. Privacy

Our processing of personal data in connection with the Service is described in our Privacy Policy. By using the Service, you acknowledge that your personal data will be processed in accordance with our Privacy Policy.

If you use Fanbea to collect or process personal data about others (for example, visitors to your pages or your own customers), you are responsible for complying with applicable data protection laws, for providing any required notices, and for obtaining any necessary consents.

11. Term and Termination

These Terms apply from the time you first access or use the Service and continue until your account is terminated or you stop using the Service.

You may stop using the Service at any time and may be able to delete your account through the settings section. If you cancel a Paid Plan, you will typically retain access to paid features until the end of the current billing period, unless we state otherwise.

We may suspend or terminate your access to the Service (including your account) if:

• You materially breach these Terms or other policies we reference.
• We are required to do so by law, a court, or a competent authority.
• Your use of the Service poses a risk to the security, stability, or reputation of the Service or others.

Upon termination, your right to use the Service will end. We may delete or restrict access to your User Content, subject to any legal retention obligations. Certain provisions of these Terms will continue to apply after termination, including those relating to intellectual property, disclaimers, limitations of liability, indemnification, and governing law.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties and representations, whether express, implied, or statutory, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and availability.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service will be free of harmful components. We are not responsible for any delays, failures, or other issues resulting from the internet, your devices, or third-party services.

13. Limitation of Liability

To the maximum extent permitted by law, Yeabunny Sp. z o.o. and its directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of profits, revenues, data, goodwill, or business opportunities, arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will be limited to the greater of (a) the amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred (100) EUR.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, such as liability for fraud or intentional misconduct.

14. Indemnification

You agree to indemnify and hold harmless Yeabunny Sp. z o.o., its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Service.
• Your User Content.
• Your breach of these Terms or applicable law.
• Any claim that your User Content infringes or violates the rights of a third party.

15. Changes to the Service and Terms

We may update or change the Service from time to time, for example to improve performance, add new features, or comply with legal requirements.

We may also update these Terms. When we make material changes, we will update the "Last updated" date at the top of this page and, where required or appropriate, notify you (for example, by email or in-app notification). Your continued use of the Service after changes become effective means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of Poland, without regard to its conflict of laws rules.

Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Poznań, Poland, unless applicable law requires another venue.

17. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. You may not assign or transfer these Terms or any of your rights or obligations hereunder without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
